We collect Nonpublic Personal Information (“NPI”) and other personal information from the following sources and in the following categories:

A. Information You Provide Directly

When you submit a mortgage inquiry, loan application, or contact form through our website or point-of-sale portal, we may collect:

  • Identification information: full name, date of birth, Social Security number, government-issued ID details;
  • Contact information: mailing address, telephone number, email address;
  • Financial information: income, employment history, assets, liabilities, account numbers, and related financial documentation;
  • Property information: subject property address, estimated value, and intended use; and
  • Other information you choose to submit in free-text fields or document uploads.

B. Information About Your Transactions

In the ordinary course of processing a mortgage application, we collect and generate information relating to your transaction with us, including payment histories, account balances, loan terms, and related correspondence.

C. Information From Third Parties

To evaluate your loan application and fulfill our legal obligations, we obtain information from:

  • Consumer reporting agencies (credit bureaus): credit reports, credit scores, and creditworthiness information, obtained pursuant to the FCRA;
  • Employers, income verifiers, and depository institutions: employment verifications, wage and income reports, asset verifications;
  • Appraisers and title companies: property condition and title history reports; and
  • Government and public records: flood zone determinations, tax records, and recorded instrument data.

D. Information Collected Automatically (Website Usage Data)

When you visit our website, our servers and third-party analytics tools may automatically collect:

  • IP address and approximate geographic location;
  • Browser type and version, operating system, and device type;
  • Pages visited, time on page, and referring URL;
  • Session identifiers and interaction logs; and

Note: Automatically collected website usage data is used for site security, fraud prevention, analytics, and improving user experience. It is not used to make credit decisions.

HOW WE USE YOUR INFORMATION

  • Complying with federal and state legal and regulatory obligations (including HMDA, ECOA, TILA, and RESPA);

  • Quality control, compliance auditing, and internal record-keeping;
  • Responding to regulatory examinations, subpoenas, or legal proceedings; and
  • Improving our website and digital services.

We do not sell your personal information to third parties for their independent marketing purposes. We do not use your NPI for marketing activities unrelated to your mortgage transaction without your separate consent.

DISCLOSURE OF YOUR INFORMATION

We disclose your NPI only as permitted or required by law.

A. To Service Providers (Permitted by Law)

We share NPI with non-affiliated companies that perform services on our behalf in connection with your mortgage transaction, including:

  • Loan origination system (LOS) vendors and technology service providers;
  • Appraisal management companies and title/settlement service providers;
  • Underwriting and fulfillment service providers;
  • Flood certification and valuation vendors; and
  • Secondary market investors (e.g., Rocket Mortgage, Fannie Mae, Freddie Mac) in connection with the sale or transfer of your mortgage loan.

All service providers are contractually required to maintain the confidentiality of your NPI and to use it only for the specific purpose for which it was provided, consistent with 12 C.F.R. § 1016.13.

B. As Required or Permitted By Law

We may disclose your information:

  • To comply with federal or state laws, regulations, or regulatory examinations;
  • In response to a court order, subpoena, or government agency request;
  • To protect against fraud, unauthorized transactions, or potential illegal activity;
  • To the extent necessary to effect, administer, or enforce your mortgage transaction; and
  • To comply with FCRA requirements, including furnishing accurate data to consumer reporting agencies.

C. Loan Transfers and Servicing

If your mortgage loan is sold or transferred to another lender or servicer, we will provide that entity with necessary loan and borrower information. You will receive written notice of any such transfer as required by applicable law, including RESPA.

D. We Do Not Sell Personal Information

Omni Lending does not sell your NPI or other personal information to third parties for their own marketing or advertising purposes. We do not share personal information for cross-context behavioral advertising.

YOUR PRIVACY RIGHTS & OPT-OUT

GLBA Opt-Out Right

Under Regulation P, you have the right to opt out of our sharing your NPI with certain non-affiliated third parties for purposes other than processing your transaction or as required by law. To exercise this right, please contact us using the information in Section 13. Opting out does not affect our ability to share information as required to process your loan or as required by law.

FCRA Rights

You have rights under the Fair Credit Reporting Act, including the right to obtain a copy of your credit report, to dispute inaccurate information, and to receive notices regarding adverse action taken on your application. A summary of your FCRA rights is provided separately at the time of application.

State-Specific Rights

Residents of certain states (including California, Colorado, Virginia, Connecticut, and others) may have additional rights, including the right to access, correct, or delete personal information not covered by the GLBA exemption. Please contact us to learn more about rights specific to your state of residence.

California residents: To the extent any personal information we hold falls outside the GLBA/FCRA exemptions, California Consumer Privacy Act (CCPA) rights may apply. Please contact us at the address in Section 13 to submit a verifiable consumer request.

DATA RETENTION

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal and regulatory record-retention obligations (including HUD, CFPB, FNMA/FHLMC, and state licensing requirements), and to resolve disputes or enforce our agreements.

Mortgage loan files are generally retained for a minimum of seven (7) years following loan consummation, payoff, or denial, as required by applicable law. When information is no longer required, we securely destroy or de-identify it consistent with our records management policies.

COOKIES & TRACKING TECHNOLOGIES

Our website uses cookies and similar tracking technologies to enhance your browsing experience, maintain session security, and gather analytics. Types of cookies we may use include:

  • Essential / Functional Cookies: Required for the website to operate correctly, including secure authentication for the loan application portal.

All credit disclosures required by the Truth in Lending Act and Regulation Z will be provided in the Loan Estimate (within 3 business days of application) and Closing Disclosure (at least 3 business days before consummation).

RESPA / Regulation X

Omni Lending complies with the Real Estate Settlement Procedures Act (RESPA) and Regulation X, including requirements related to affiliated business arrangement disclosures, anti-kickback provisions, and the provision of good faith estimates of settlement costs through the Loan Estimate.

CAN-SPAM Act

GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions, and applicable federal law.

Any dispute arising out of or relating to these Terms or your use of this website that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Clark County, Nevada. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm. Nothing in this section limits your rights under applicable federal consumer protection statutes, including the Consumer Financial Protection Act, TILA, RESPA, or ECOA.

CLASS ACTION WAIVER: TO THE EXTENT PERMITTED BY LAW, YOU AND OMNI LENDING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Omni Lending reserves the right to revise these Terms at any time to reflect changes in our practices, legal requirements, regulatory guidance, or business operations. SEVERABILITY & ENTIRE AGREEMENT
